James Barrett of Number Twenty four Dominick Street In the City of Dublin Gentleman maketh Oath and Saith He is a suscribing Witness to, and saw the deed of which the foregoing is a Memorial - and also said Memorial duly executed by Peter Smithwick one of the executing parties thereto - And Saith the name James Barrett subscribed as a Witness to said Deed and Memorial is this Deponent's proper name and handwriting - Saith he delivered said deed and this Memorial to Walter Glascod Esquire the Assistant Registrar at five minutes before three oclock on the 3rd day of February 1840.

To the Register Appointed by act of Parliament for Registering Deeds, Wills, Leases & Soforth

A Memorial of an Indented deed of Conveyance bearing date the twenty second day of January one thousand Eight hundred and thirty nine between Acheson Lyle Esquire Second Remembrances of Her Majesty's Court of Exchequer in Ireland of the first part; Peter Smithwick late of Suirville in the County of Tipperary and Rebecca his Wife of the second part; George Evans of the City of Cashel who with William Smithwick deceased was named a Trustee in and by a certain Indenture of Settlement bearing date the first day of March one thousand Eight hundred and twenty two being the Settlement executed on the Intermarriage of the said Peter Smithwick therein described as Peter Smithwick the younger of the third part; The Reverend George Smithwick Rector of Lechpatrick in the County of Tyrone Clerk who with Peter Smithwick late of Barnlough in the County of Tipperary deceased was alsonamed a Trustee in and by said Settlement of the fourth part; Elizabeth Smithwick of the City of Dublin Spinster of the fifth part; Prudence Edwards of Dorset Street in the City of Dublin to whom an annuity was granted by Indenture bearing date the Twenty fourth of October one thousand Eight hundred and twenty two by said Peter Smithwick of the Sixth part; Amos Speer, James Durham, The Honorable Robert Torrens and Richard Donovan Speer as Executors of Solomon Speer a Trustee named in said last mentioned deed of Annuity of the Seventh part; Thomas Smithwick Manning of Ruan Lodge in the County of Tipperary of the eight [sic] part; and whichsaid Prudence Edwards, Robert Torrens, Richard Donovan Speer, Thomas Smithwick Manning are with others Defendants in a certain Cause instituted by the said Elizabeth Smithwick in her Majesty's Court of Exchequer and therein after particularly mentioned as Creditors of said Peter Smithwick And Wiliam Roche of the City of Dublin Atty [attorney] of the Ninth part, Whereby after Reciting that by a certain Indenture of Lease bearing date the Eighteenth day of November One thousand Seven hundred and forty six and made between Mrs. Aime Foulke then in Youghall in the County of Cork widow of the one part and Peter Smithwick then of Kilduffe in the County of Limerick Gentleman of the other part - the said Aime Foulke demised unto the said Peter Smithwick in his possession then being All that and those that hail of the Lands of Ballycannon now called Suirville containing one hundred and forty acres plantation measure more or less situate in the Barony of Clanwilliam and County of Tipperary To hold for the lives therein mentioned at the yearly rent of sixty pounds Sterling of the then Currency, with a Covenant for perpetual renewal on payment of the Sum of Twenty five pounds of the like Currency, And Also Reciting that several renewals were had of said lease, And Also Reciting a certain deed of Settlement bearing date the first day of March one thousand eight hundred and twenty two being the Settlement entered into on the Intermarriage of the said Peter Smithwick the younger with Rebecca Smithwick party thereto - the said Lands of Suirville with others were conveyed to the said George Smithwick and Peter Smithwick Trustees therein for a term of Ninety nine years upon trust to raise a Sum of Three hundred pounds as the said Peter Smithwick should by deed or Will approved it that said Sum when so raised should be paid to said Elizabeth Smithwick party thereto - And reciting the Will of the said Peter Smithwick whereby he appointed said Sum of Three hundred pounds to be paid said Elizabeth Smithwick - And Reciting a Decree of the Court of Exchequer in Ireland - And that the Chief Remembrance of said Court did in pursuance of said decree set up and Sell the said Lands of Suirville, and that William Roche party thereto had been declared the purchaser thereof for the residue of said term of Ninety nine years from the first day of March one thousand Eight hundred and twenty two, and that the said Second Remembrance and the several other parties therein conveyed to the said William Roche All that and those the said Town and Lands of Ballycanon otherwise Suirville Containing one hundred and sixty acres or thereabouts situate lying and being in the Barony of Clanwilliam and the County of Tipperary To hold into the said William Roche his Execs Admins and assigns for the residue and Remainder of said term of Ninety nine years there to come and unexpired, Subject to the payment of the yearly Rent and Renewal fees made payable by said original Indenture of Lease which said deed also the Execution thereof by the said Peter Smithwick is witnessed by James Barrett of Number Twenty four Dominick Street in the City of Dublin Gentleman, and this Memorial as to the Execution thereof by the said Peter Smithwick is witnesseed by the said James Barrett and by William Williams of Golden in the County of Tipperary Farmer -
