KING'S BENCH DIVISION (PROBATE)
This is the last Will and Testament of me William FitzWilliam Smithwick of Youghal House Nenagh in the County of Tipperary made this 6th (Sixth) day of July in the year of Our Lord one thousand eight hundred and ninety four (1894). I hereby revoke all Wills by me at any time hereto foremade. I appoint my Sister Harriet Elizabeth Smithwick and Elsie Smithwick of Youghall House Nenagh to be my Executrixes and direct that all my just debts and Funeral and Testamentary expenses shall be paid as soon as possible after my decease. I hereby give and bequeath unto my two Sisters fondly share and share alike all my real and personal Estate their names are Harriet Elizabeth Smithwick and Elsie Smithwick of Youghall House Nenagh for their lifetime and after their death to go to my brother Robert John Smithwick of Tahnaboro Australia his heirs and assigns forever. In witness whereoff [sic] I have hereunto set my hand this Sixth of July One thousand and eight hundred and ninety four -

Be it known that on the 6th day of July 1909 the last Will a Copy of which Signed by the District Registrar is hereunto annexed of William Fitzwilliam Smithwick late of Youghal House Nenagh in the County of Tipperary late Captain in His Majesty's 47th Regiment deceased who died on or about the 7th day of April 1909 at same place and who at the time of his death had a fixed place of abode at Youghal House Nenagh within the District of Limerick was proved and registered in the District Registry of the said Division of Limerick and that the Administraiton of all and Singular the personal estate of the said deceased was granted by the aforesaid Court to Harriet Elizabeth Smithwick and Elsie Smithwick both of Youghal House Nenagh aforesaid Spinsters Sisters of deceased the Executrixes named in the said Will they having been first Sworn faithfully to administer the same and it is hereby Certified that an affidavit for Inland Revenue has been delivered wherein it is show that the gross value ofpersonal Estate of the said deceased within the United Kingdom (exclusive of what the deceased may have been possessed of or entitled to as Trustee and not beneficially) amounts to £13500 12 4 for the purpose of Estate Duty and that it appears by a receipt singed by an Inland Revenue Officer on the said affidavit that £283 5 10 for Estate Duty and interest thereon has been paid the Duty being charged thereon of the rate of £3 0 0 per Cent
